RELEASE, HOLD HARMLESS AND AGREEMENT

SURFING MADONNA OCEANS PROJECT

I fully understand that my participation in the Surfing Madonna Surf Camp (hereinafter “EVENT”) is a potentially hazardous activity that exposes my child(ren) and myself to the risk of personal injury, death or property damage. I hereby acknowledge that I am voluntarily participating in this event, am medically able and properly trained and agree to assume any such risks associated with surfing in the event, including but not limited to falls in and out of the water, contact with other participants, effects of weather (high heat/humidity/rain), waves, tripping over rocks/debris on the beach, or colliding with other surfers or onlookers.

I hereby release, discharge and agree not to sue the Surfing Madonna Oceans Project organization, the City of Encinitas, City of Carlsbad, City of Oceanside, Surfin Fire Surf School, and the Sate of California and/or their officers, agents, employees, and volunteers (hereinafter, RELEASEES) for any injury, death or damage to or loss of personal property arising out of, or in connection with, my participation in the EVENT from whatever cause, including the active or passive negligence of RELEASEES or any other participants in the EVENT.

In consideration for being permitted to participate in the EVENT, I hereby agree, for myself, my heirs, administrators, executors and assigns, that I shall indemnify and hold harmless RELEASEES from any and all claims, demands actions or suits arising out of or in connection with my participation in the event/class.

I understand that photos will be taken of my child and may or may not be used for marketing purposes. 

The current plan is for Surf Camp to be held South of the Pier in Oceanside and Encinitas depending on which date is chosen, however if beach conditions are not adequate as determined by Surfing Madonna Oceans Project, Surf Camp may be moved to another nearby location with as much pre-notification as possible.  

These surf lessons are facilitated by a variety of helpers, such as teen volunteers from local civic groups, volunteers from the community, or surf school staff.

I HAVE CAREFULLY READ THIS RELEASE, HOLD HARMLESS AND AGREEMENT NOT TO SUE AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT IT IS A FULL RELEASE OF ALL LIABILITY AND SIGN ON MY OWN FREE WILL.
