RELEASE, HOLD HARMLESS AND AGREEMENT NOT TO SUE

SURFING MADONNA OCEANS PROJECT/ENCINITAS HALF MARATHON

I, fully understand that my participation in the Encinitas Half Marathon (hereinafter “EVENT”) is a potentially hazardous activity that exposes me to the risk of personal injury, death or property damage. I hereby acknowledge that I am voluntarily participating in this event, am medically able and properly trained and agree to assume any such risks associated with running in the event, including but not limited to falls, contact with other participants, effects of weather (high heat/humidity/rain), exhaustion, tripping over debris on the road, colliding with other runners or onlookers or being hit by a car whether it may be your fault or the fault of the driver.

I hereby release, discharge and agree not to sue the Surfing Madonna Oceans Project organization, the City of Encinitas and/or their officers, agents, employees, and volunteers (hereinafter, RELEASEES) for any injury, death or damage to or loss of personal property arising out of, or in connection with, my participation in the EVENT from whatever cause, including the active or passive negligence of RELEASEES or any other participants in the EVENT.
In consideration for being permitted to participate in the EVENT, I hereby agree, for myself, my heirs, administrators, executors and assigns, that I shall indemnify and hold harmless RELEASEES from any and all claims, demands actions or suits arising out of or in connection with my participation in the event/class.

There is a strict no refund policy. By agreeing to the terms above you are also stating that you have read and understand all conditions set forth on the Encinitas Half Marathon website.

I HAVE CAREFULLY READ THIS RELEASE, HOLD HARMLESS AND AGREEMENT NOT TO SUE AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT IT IS A FULL RELEASE OF ALL LIABILITY AND SIGN ON MY OWN FREE WILL.
